Website Terms of Use
1. Scope and who we are
These Website Terms of Use (Terms) govern access to and use of Saywell’s public marketing pages at saywellhq.com and Saywell assessment pages (together, the Public Surfaces). They are provided by PsycFin Pty Ltd (ABN 81 697 454 345), an Australian company (PsycFin, we, us). Saywell is a product of PsycFin. It is not a separate legal entity or a registered business name used by PsycFin.
These Terms do not govern an adviser firm’s subscription to or use of the logged-in Saywell product. That relationship is governed by the Adviser Terms of Service and Data Processing Addendum accepted by the firm. Subscription pricing, renewals, cancellations and refunds are addressed in the Adviser Terms and Refund and Cancellation Policy.
2. Acceptance, age and permitted markets
By using a marketing page, you agree to comply with these Terms. Before beginning an assessment, you must affirmatively accept the assessment terms presented at the start. PsycFin records the version, time and method of acceptance.
Assessment-takers must be at least 18 years old. Saywell does not create communication profiles for minors. A minor may be mentioned incidentally in information lawfully supplied about an adult’s matter, but a person must not complete an assessment for a minor or pretend to be another person.
The Public Surfaces are directed to people in the United States and Australia. They are not directed to people in the United Kingdom, European Union or European Economic Area. Do not use an assessment or submit personal information if you are located in one of those excluded places.
3. What Saywell is, and is not
Saywell assists financial advisers with communication drafting and helps adults understand communication preferences. Marketing pages, articles, examples, assessment profiles and reports provide general information about communication. They are not financial, investment, tax, legal, regulatory, compliance, psychological, medical or other professional advice.
PsycFin is not your financial adviser, lawyer, tax adviser, psychologist or health professional. Saywell does not diagnose a condition, assess mental health, recommend a financial product or decide what an adviser should communicate. Do not delay or replace professional help because of information on a Public Surface.
If you face an immediate personal, medical or safety emergency, contact the appropriate emergency or crisis service in your location. The Public Surfaces are not monitored or designed for emergency assistance.
4. Assessments
4.1 Purpose and limits
An assessment asks about how you prefer to receive and process information. It may produce a communication profile and report. A profile is a practical communication aid, not a clinical, diagnostic, aptitude, personality, creditworthiness or financial-capacity assessment. Results may be incomplete, simplified or affected by the answers and technical methods used.
You remain responsible for deciding whether a result is useful to you. An adviser remains solely responsible for professional communications and decisions. Neither you nor an adviser should use a profile to make an automated decision about eligibility, service, credit, employment, insurance, health or another matter with legal or similarly significant effects.
4.2 Adviser-linked assessments
If an adviser invites you or you choose to link your result to an adviser, the assessment page identifies that adviser and asks you to authorise sharing. The adviser receives the communication profile and report, not your raw assessment responses. You may decline to link or share unless an independent legal or contractual requirement applies outside Saywell.
4.3 Standalone assessments
If you take an assessment without an adviser relationship, PsycFin provides the result directly to you. Identifiable standalone assessment responses, profile, report and contact details are deleted after 18 months without meaningful activity, or earlier on a verified request, as described in the Privacy Policy. Linking to an adviser changes the record to the adviser-account retention rules from that point.
4.4 Corrections
If a communication profile measured from your own assessment is disputed, the primary correction remedy is a fresh assessment, whose result replaces the prior profile in full. PsycFin does not manually alter measured results. Other verified factual errors and correction requests are handled under the Privacy Policy.
5. Artificial intelligence
Saywell uses an Anthropic Claude model that has passed PsycFin’s retention and quality verification to help generate assessment reports and other authorised material. Artificial-intelligence outputs may contain errors, omissions, bias, inconsistency or material that appears confident but is not reliable.
PsycFin reduces identifiable information sent for AI processing by replacing stored names, email addresses and unnecessary adviser or firm identifiers with neutral placeholders and restoring necessary names locally after generation. This does not remove every possible identifier from free text. Names, nicknames or third-party details entered in supplied text may remain. Full dates of birth, account identifiers and raw assessment answers are excluded from the AI request.
Unless PsycFin has completed and documented its Zero Data Retention verification gate, Anthropic’s commercial service may retain prompts and outputs for approximately 30 days, with limited longer retention in circumstances described in its terms. Anthropic does not use commercial API content to train its general models by default, and PsycFin does not permit that use. The Privacy Policy contains the current disclosure.
6. Acceptable use
You must not:
• break any law, infringe another person’s rights, impersonate another person or submit information you are not authorised to provide;
• use an assessment for a person under 18, for a person in an excluded market, or to make a prohibited automated or high-impact decision;
• enter government identifiers, passwords, authentication codes, financial account numbers, payment credentials or unnecessary sensitive information;
• probe, scan, attack, overload, bypass or interfere with the security or operation of a Public Surface;
• scrape, harvest or systematically extract Public Surface content, or use automated means except with PsycFin’s written permission;
• reverse engineer or attempt to discover non-public assessment scoring, prompts, rules, models or technical methods;
• use Public Surface content or assessment materials to train, evaluate or develop a competing artificial-intelligence or machine-learning system; or
• remove ownership notices, misrepresent an affiliation with PsycFin or use PsycFin or Saywell branding without written permission.
PsycFin may restrict access to the extent reasonably necessary to address misuse, unlawful conduct, a security risk, harm to another person or a binding legal requirement. Where circumstances permit, PsycFin gives notice and a reasonable opportunity to stop or correct the conduct.
7. Information you provide
You retain any rights you hold in information you submit. You give PsycFin a limited, non-exclusive licence to host, copy, transmit, analyse, transform and otherwise process that information only as reasonably necessary to provide the requested assessment or Public Surface function, maintain security, meet legal obligations and perform the practices described in the Privacy Policy.
You represent that information you submit is yours to provide, is not knowingly false or unlawful and does not violate another person’s confidentiality, privacy or intellectual-property rights. Free-text fields cannot prevent prohibited or unnecessary information from being entered, and Saywell does not promise to detect or redact it.
8. PsycFin intellectual property
PsycFin and its licensors own the Public Surfaces, assessment questions and structure, scoring and communication-profile methods, software, designs, text, graphics, brands and other materials, except for information you submit and third-party materials. PsycFin grants you a limited, personal, non-exclusive, non-transferable and revocable permission to use the Public Surfaces for their intended lawful purpose.
No right is granted to copy, publish, sell, license, create derivative products from or commercially exploit Public Surface content except with PsycFin’s written permission or where law expressly permits it. A report supplied to you may be retained and used for your own lawful personal purposes.
9. General content and third-party links
Articles, books, podcasts, examples and other marketing content are general commentary provided in good faith. They may not be current, complete or suitable for your circumstances. PsycFin may correct or remove content without notice.
A Public Surface may link to a third-party website, store, podcast, social platform or service. The third party controls its own service, terms and privacy practices. A link does not mean PsycFin endorses or accepts responsibility for the third party.
10. Privacy and tracking
The Privacy Policy at /privacy explains what information PsycFin collects, why it is used, overseas and AI processing, retention, privacy requests, learning opt-outs, security practices and marketing-site tracking. It is a disclosure of PsycFin’s privacy practices and does not reduce any right or obligation that applies by law.
Advertising and analytics tags, including Google Tag Manager and Google advertising tags, may operate on marketing pages as disclosed in the Privacy Policy. They are prohibited from collecting form-field values or information you type into Saywell forms. Assessment pages carry no advertising or analytics trackers.
11. Availability and security
PsycFin uses reasonable care in providing the Public Surfaces and reasonable safeguards appropriate to the information handled. Internet, hosting, email, AI and other provider services may nevertheless experience outages, delay, loss or error. PsycFin does not promise uninterrupted, error-free or permanently available Public Surfaces.
Do not use a Public Surface as the only place you retain important information. Keep your own copy of a report you wish to preserve, subject to the retention and export rights described in the Privacy Policy.
12. Responsibility and liability
12.1 Allocation of responsibility
You are responsible for information you choose to submit and decisions you make in reliance on general content or an assessment result. An adviser firm is responsible for the professional content it approves and sends. PsycFin remains responsible for its own breach of these Terms, negligence, unlawful conduct and non-excludable legal obligations, subject to the lawful limitations below. Nothing in these Terms is an absolute disclaimer of PsycFin’s responsibility.
12.2 Excluded loss and cap
To the extent permitted by law, PsycFin is not liable under these Terms for indirect, incidental, special or consequential loss, or for loss of profit, revenue, opportunity, goodwill or anticipated savings. Subject to section 12.3, PsycFin’s total aggregate liability arising from the Public Surfaces and these Terms is limited to AUD $100.
12.3 Exceptions and mandatory rights
The exclusions and cap do not apply to fraud, wilful misconduct or any liability, guarantee, right or remedy that cannot lawfully be excluded or limited. Nothing in these Terms excludes, restricts or modifies a protection applying by law and incapable of exclusion, including an applicable protection under the Australian Consumer Law.
Where the Australian Consumer Law permits liability for a failure to comply with an applicable consumer guarantee concerning services not ordinarily acquired for personal, domestic or household use to be limited, PsycFin’s liability is limited, at PsycFin’s option, to supplying the services again or paying the cost of having them supplied again. This applies only where section 64A permits it and reliance on the limitation is fair and reasonable.
13. Changes to these Terms
PsycFin may update these Terms prospectively. A material change affecting people who continue to use an assessment or another ongoing Public Surface is notified at least 30 days in advance by an appropriate recorded notice where reasonably practicable. A change required urgently for security or law may take effect sooner, with notice as soon as reasonably practicable. Routine clarifications, link or provider-detail updates and changes that reduce processing take effect when published with an updated effective date.
A new use of previously collected personal information that requires consent or another legal basis will obtain that basis separately. Updating these Terms or the Privacy Policy does not itself create consent to a materially different use.
14. Governing law and general terms
These Terms are governed by the laws of Queensland, Australia, without regard to conflict-of-laws principles. Subject to any mandatory right to bring proceedings elsewhere, you and PsycFin submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from them. Mandatory protections of your place of residence remain available where they cannot lawfully be excluded.
If a provision is unenforceable, it is read down to the minimum extent necessary or severed, and the remaining provisions continue. A failure to enforce a right is not a waiver. These Terms do not create an employment, agency, partnership, joint venture or fiduciary relationship.
